PERAYAAN Imlek hari Jumat, (16/2/2018), kemarin mungkin jadi perayaan paling menyedihkan bagi Ahok. Selain tak ditemani keluarga, khususnya anak dan sang istri, ia juga merayakan Imlek dalam tahanan sebagai narapidana. Situasi yang pasti tak pernah terpikirkan oleh mantan Gubernur DKI Jakarta ini.
Sejak ditahan di Mako Brimob, Kelapa Dua, Depok, 10 Mei 2017 silam, Basuki Tjahaja Purnama alias Ahok seolah dalam keadaan baik-baik saja. Pengacara maupun orang yang menjenguknya bergantian mengatakan jika Ahok semakin baik dalam segala aspek, khususnya kerohanian, ia juga kian tenang, dan sabar serta kuat secara mental. Selain rajin beribadah, ia juga membalas surat yang dikirimkan masyarakat sembari terus berolahraga.
Kini Ahok memunculkan sebuah kejutan. Sudah hampir dua bulan, tak ada satu pun keluarga yang menjenguk, bahkan oleh kuasa hukumnya. Petugas kepolisian yang berjaga di Mako Brimob Kelapa Dua menyebut, ketidakhadiran mereka diminta langsung oleh Ahok.
Saya ingat sekitar dua bulan lalu pula, cerita tentang perceraiannya terkuak. Keluarga yang harmonis dan istimewa itu, hancur seketika. Ia masuk penjara kemudian berpisah. Ternyata di dalam sel Mako Brimob itu Ahok memendam “magma”. Serupa gunung yang hendak meluap dia menyimpan beberapa hal, salah satunya akhir pernikahannya bersama Veronica.
Kabarnya, Ahok menggugat cerai sang istri karena berselingkuh, jauh sebelum ia ditahan. Mengapa baru kini ia menceraikan Veronica? Wanita yang menemaninya sejak meniti karir. Saya menangkap hal lain, Ahok memutuskan bertarung sendirian. Ia tak ingin keluarganya terlibat, pada arus deras serta genderang perang yang mesti dituntaskannya, ia siap dengan segala konsekuensi. Sendirian.
Sambil mengurus perceraian, Ahok menyingkap misteri dari peristiwa di atas. Ia telah mengajukan peninjauan kembali alias PK terhadap kasus penistaan agama yg menjeratnya. Padahal 8 bulan lalu ia menolak mengajukan banding, saat putusan masa kurungannya dibacakan. Ahok pun baru mengajukan PK ini seusai keputusan Pengadilan Negeri Bandung yang memvonis Buni Yani 1,5 tahun penjara. Vonis Buni Yani dibacakan pada Selasa, (14/11/2017) hampir 3 bulan lalu.
Buni Yani dinilai bersalah karena melakukan pemotongan video Ahok di Kepulauan Seribu. Bisa saja keputusan itu meringankan tuduhan Ahok, tanpa berharap lebih bahwa vonis kepada Buni Yani akan menggugurkan seluruh hukumannya. Karena bagaimanapun juga, menurut saya Ahok tetap harus dihukum, ia kurang peka terhadap omongannya.
Tak ada yang salah dari keinginan Ahok untuk PK. Fasilitas tersebut adalah hak semua warga negara. Toh kita masih punya harapan pada hukum negeri ini. Sambil tetap mengawal, agar tidak ada intrik dari proses pengadilan ini. Jaksa penuntut umum, maupun hakim nantinya haruslah memiliki rekam jejak bagus. Baiknya PK Ahok tidak melibatkan pihak yang terkait pada kedua kubu, yang selama ini kadung terpola.
Seperti suara sumbang yang dilontarkan Eggi Sudjana, pengacara Habib Rizieq sekaligus pentolan alumni 212. Ia mencurigai bahwa Ahok akan mendapat previlege atau keistimewaan dalam pengajuan PK-nya dari pemerintah.
Eggi Sudjana menangkap adanya keganjilan lantaran pasca vonis bersalah pada Mei 2017 lalu. Ahok sama sekali tidak melakukan upaya hukum. Selanjutnya Eggi menuturkan langkah Ahok itu tidak sesuai dengan logika hukum. Sebelum PK, kata dia, mesti ada tiga unsur penting, yaitu adanya novum (bukti baru), kekhilafan hakim, dan penerapan hukum yang tidak sistematis atau berbeda-beda.
“Ini memang akal-akalan, langsung sidang, cepat sekali, bisa bebas cepat dia. Terdakwa yang mengajukan PK tidak akan dihukum melebihi masa hukuman sebelumnya,” kata Eggi.
Rizieq Contohlah Ahok
Eggi dan kelompoknya seharusnya bisa menahan diri. Jangan membuat gaduh. Alangkah baiknya tidak hanya menuntut pihak lawan berlaku adil, tapi juga kepada kawannya. Habib Rizieq yang sampai saat ini masih berada di luar negeri baiknya mengikuti proses hukum yang berlaku juga, seperti Ahok. Menempuh berbagai instrumen hukum yang ada. Jika memang tidak bersalah tentu akan bebas, toh masyarakat kian peduli pada kerja penegakan hukum di negeri ini.
Jangan malah menyerang Ahok yang hendak menggunakan haknya, bahkan berencana melakukan demonstrasi besar-besaran saat sidang perdana. Langkah pertama katanya yang akan dilakukan adalah menyurati Mahkamah Agung serta menggelar konferensi pers, hingga yang terakhir demonstrasi.
“Kalau tetap jalan (PK) demolah besar-besaran,” kata Eggi pada konferensi persnya.
Saya tidak tahu apakah Ahok memiliki novum atau benar ia hanya menjadi korban dari kekeliruan Buni Yani. Namun, baiknya kita mengikuti alurnya saja. Adapun mengenai cepatnya MA memproses PK tersebut baiknya Eggi husnuzan bahwa MA berniat segera memutus PK ini, agar tidak menimbulkan pro kontra terlalu lama di masyarakat. Sehingga menimbulkan keributan dan perpecahan lagi. Mari kita tunggu keputusan pengadilan tertinggi tersebut.
Semua pihak mesti menahan diri. Tak perlu demo yang akan mempertajam pola perbedaan. Apalagi sampai mengancam pihak tertentu, seperti yang dilontarkan Ketua Presidium Alumni 212 Slamet Maarif.
“Jangan mancing-mancing deh. Pemerintah jangan mancing-mancing umat,” katanya kepada media.
Pihak Slamet sangat keberatan dengan PK itu karena baginya merupakan ketidakadilan hukum. Maarif belum dapat memastikan apakah akan menggelar demonstrasi seperti Eggi Sudjana atau tidak pada sidang perdana PK Ahok pekan depan di PN Jakarta Utara. Tapi dia menunggu instruksi setelah kedatangan Habib Rizieq, 21 Februari 2018.
Apalagi alumni 212 juga terlihat pecah. Salah satu pendiri Presidium Alumni 212, Faizal Assegaf berbeda pandangan. Ia menyarankan sikap ksatria Ahok perlu ditiru Rizieq dalam menjalani proses hukum.
Kepada media, Faizal mengatakan, jika Rizieq pulang maka sebaiknya mendatangi kepolisian untuk menjalani proses hukum yang ada.
“Jiwa ksatria Ahok mesti diteladani Habib Rizieq Shihab, ada kalanya kita belajar dari musuh juga,” kata Faizal di Jakarta menanggapi rumor kepulangan Rizieq.
Rizieq hanya perlu menjalani proses hukum yang berlaku, dimana dirinya saat ini masih berstatus terduga. Sehingga, tak perlu mengerahkan massa untuk menekan pemerintah, melepaskan dirinya atau menangkap seseorang. Ahok bisa memberi contoh padanya.
